1. Purpose

Frigipan (Pty) Ltd respects your privacy and processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and other applicable South African law. This Privacy Policy explains what we collect, why we use it, who we share it with and the choices available to you.

2. Responsible party

Frigipan is the responsible party for personal information processed through the Website and in connection with enquiries, quotations, customer accounts, orders and after-sales support.

3. Information we may collect

We may collect:

names, identity or company-registration information;
job titles and company details;
delivery, billing and physical addresses;
telephone numbers, WhatsApp numbers and email addresses;
account login and communication preferences;
quotation, order, invoice and payment-reference information;
product requirements, measurements, drawings, specifications and project details;
correspondence, support requests and complaint information;
website usage information, IP address, device and browser information; and
any other information you voluntarily provide.

We do not intentionally collect payment-card details through the Website unless a secure payment service is introduced and clearly identified.

4. How information is collected

Information may be collected directly from you when you use a form, contact us, create an account, request a quotation, place an order, communicate by email or WhatsApp, or visit our premises. We may also receive information from your employer, authorised representative, contractor, courier, payment provider or publicly available business source where lawful.

5. Purposes of processing

We process personal information to:

respond to enquiries and prepare quotations;
create and manage customer or supplier accounts;
confirm, manufacture, supply, collect and deliver orders;
issue invoices, process payments and maintain financial records;
communicate about production, stock, collection, delivery or support;
assess complaints, returns, warranty and quality matters;
improve our products, customer service and Website;
protect our systems, detect misuse and maintain security;
send marketing where permitted and manage opt-outs; and
comply with legal, regulatory, tax and recordkeeping obligations.

6. Lawful grounds

Depending on the circumstances, we process information because it is necessary to enter into or perform a contract, comply with a legal obligation, pursue a legitimate business interest, protect a legitimate interest, or because you have given consent.

We may share information only where reasonably necessary with:

employees and authorised representatives who require it for their work;
couriers, transporters and logistics providers;
hosting, email, accounting, CRM, security and IT service providers;
professional advisers, auditors and insurers;
banks and payment providers; and
regulators, law-enforcement bodies or courts where required by law.

Service providers are expected to protect the information and use it only for the agreed purpose. We do not sell personal information.

8. International transfers

Some service providers may store or process information outside South Africa. Where this occurs, Frigipan will take reasonable steps to ensure that the recipient is subject to an adequate level of protection, an appropriate agreement, binding corporate rules, consent or another lawful basis under POPIA.

9. Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to complete a transaction, handle a warranty or dispute, comply with tax and other legal requirements, or protect legitimate interests. Information that is no longer required will be deleted, destroyed or de-identified where reasonably practicable.

10. Security

We use reasonable technical and organisational safeguards to protect personal information against loss, unauthorised access, misuse, alteration or disclosure. No electronic system is completely secure, but we review risks and improve safeguards where appropriate.

If a security compromise affects your personal information, Frigipan will take reasonable steps to investigate, limit the impact and provide notifications required by law.

11. Direct marketing

We may send product news or marketing only where permitted by law. Electronic marketing will identify the sender and provide a reasonable way to opt out. You may unsubscribe at any time by using the supplied link or contacting info@frigipan.co.za. Service messages about an active quotation, order, account or legal notice are not marketing.

12. Your rights

Subject to POPIA and applicable limitations, you may request that Frigipan:

confirm whether we hold your personal information;
provide access to that information;
correct or update inaccurate information;
delete information that we are no longer authorised to retain;
restrict or object to certain processing; or
stop direct marketing.

We may ask for proof of identity before acting on a request. Some information must be retained by law or for legitimate contractual, dispute or recordkeeping purposes.

14. Children

The Website is intended for business customers and adults. We do not knowingly collect personal information from children without the consent or authorisation required by law.

15. Third-party websites

Links to third-party websites are provided for convenience. Their privacy practices are controlled by their own policies, and Frigipan is not responsible for those practices.

16. Updates

We may update this policy to reflect operational or legal changes. The latest version and effective date will be published on the Website.
